Public Law

ADVANT Beiten is awarded as "Leading Firm" in the legal field of Public Law.

(The Legal 500 Germany 2024)

Our team of specialised lawyers, among them specialists for Administrative Law and former members of public bodies, sees itself as a public sector service provider, both to authorities and public enterprises for the fulfilment of their tasks as well as to private enterprises when it comes to dealing with public authorities.

We deal with matters of public commercial law and regulation, including fundamental public law issues, often in interdisciplinary teams with labour, tax and corporate lawyers.

In our clients' fields of activity, we actively follow and accompany legislative projects and legal developments at European and national level.

At a glance:

  • Structuring of privatisation projects, selection of contractual partners for PPP projects, in particular at the interface with public procurement and corporate law.
  • Drafting and negotiating contracts, monitoring contract implementation (contract consequence management)
  • Advice on administrative organisation, civil service, finance and budget law as well as on levies (fees, contributions, special charges)
  • Design and notification of EU subsidies, application for or representation in claims for the return of subsidies
  • Procurement of necessary permits, concessions and licenses, also cross-border
  • Representation in administrative proceedings, before supervisory and regulatory authorities, in arbitration proceedings and before European and German courts, including extraordinary legal remedies (e.g. constitutional complaint)
  • Pursuit of claims for damages and compensation (e.g. claims arising from official liability)

We answer your planning and building law questions with our team of experts. We support federal, state and local authorities, private investors and developers, builders and architects as well as banks and investment companies in all phases of their projects.

This includes advice on site selection and assessment of the situation under building and planning law aspects with regard to the development potential and the prerequisites of use or building development. Furthermore, negotiation of the necessary agreements (e.g. urban development contracts, land improvement contracts), procurement of the necessary permits and licenses as well as the extrajudicial and judicial enforcement of building law.

Our range of advisory services also includes support and assistance with infrastructure projects, particularly in the areas of transport and renewable energies. We have also been advising buyers and sellers, investors, owners as well as operators of facilities for many years, especially on environmental issues. Close coordination with the competent authorities and other parties involved (such as environmental experts, technical and economic consultants, architects and project managers) enables us to find economical and pragmatic solutions.

Our special expertise also includes agricultural-specific issues of energy law, building and planning law as well as food law.
